1. Introduction

Welcome to Design Battle ("Design Battle", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the Design Battle website located at https://battle.design, including any competitions, educational programs, events, workshops, digital content, and related services (collectively, the "Services").

By creating an account, registering for a Competition, submitting a Competition Entry, purchasing any paid Services, or otherwise using the Website, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Website or our Services.

Certain Competitions or Services may have additional eligibility requirements, deadlines, submission requirements, judging criteria, prizes, fees, or other conditions published on the relevant Competition page.

2. Our Services

Design Battle provides an online platform where designers and creative professionals can participate in design competitions, educational activities, workshops, community initiatives, and other creative events.

Depending on the specific Competition or Service, users may:

create a personal account;
register for Competitions;
submit creative work;
receive feedback from judges or mentors;
participate in educational activities;
access digital materials;
receive certificates, awards, or prizes where applicable.

Some Services may be provided free of charge, while others may require payment. Pricing, payment terms, and any specific conditions will be displayed on the Website or within the relevant Competition or Service.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, provided that such changes do not affect rights already granted to participants in an ongoing Competition unless required for legal, technical, or security reasons.

3. Eligibility and User Accounts

To use certain Services, you may be required to create an account.

By creating an account, you represent and warrant that:

the information you provide is accurate and complete;
you will keep your account information up to date;
you are legally capable of entering into these Terms under the laws applicable to you;
if you are under the age of legal majority in your jurisdiction, you have obtained the consent of your parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account.

You must promptly notify Design Battle if you believe your account has been accessed without authorization or if your login credentials have been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent, abusive, or unlawful activities.

4. Competitions

Design Battle organizes and hosts design competitions, creative challenges, workshops, and other community activities through the Website.

Each Competition may include its own description, eligibility requirements, deadlines, judging criteria, submission requirements, prizes, fees, and other specific conditions, which will be published on the relevant Competition page. By registering for a Competition, you agree to comply with those conditions, which form part of these Terms.

By registering for a Competition, you agree to comply with all applicable competition rules.

Registration

To participate in a Competition, you may be required to complete a registration process and provide accurate and complete information.

You are responsible for ensuring that all submitted information remains accurate throughout the Competition.

Competition Entries

Competition Entries must be submitted before the applicable deadline and in the format specified for the relevant Competition.

You are solely responsible for the content of your submission.

Design Battle may reject, remove, or request modifications to a Competition Entry that does not comply with these Terms or the applicable competition rules.

Judging

Competition Entries may be evaluated by one or more judges, mentors, industry experts, or evaluation panels appointed by Design Battle.

Judging decisions are made in good faith based on the applicable evaluation criteria and are final, except where Design Battle determines that a material error, fraud, or technical issue has affected the results.

Winners and Awards

Where applicable, winners, finalists, rankings, certificates, prizes, or other awards will be announced in accordance with the competition rules.

Design Battle reserves the right to verify a participant's eligibility before issuing any prize or award. If a winner cannot be contacted, fails to provide the requested information within the specified period, or is found to be ineligible, Design Battle may select an alternative winner or decide not to award the prize.

If a participant is found to have violated these Terms or the applicable competition rules, Design Battle may revoke any award, certificate, ranking, or prize.

5. Competition Entries and Intellectual Property

You retain ownership of all intellectual property rights in your Competition Entry unless otherwise stated in the applicable competition rules.

By submitting a Competition Entry, you grant Design Battle a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, and archive your submission solely for the purpose of administering the Competition, announcing results, promoting Design Battle, showcasing participants' work, documenting Competitions, and maintaining historical archives.

By participating in a Competition, you acknowledge and agree that your Competition Entry, your name (or public profile name), and, where applicable, your ranking, award, or other Competition results may be published on the Website and Design Battle's official communication channels, including social media, for the purpose of administering the Competition, announcing results, promoting Design Battle, and showcasing participants' work.

This license includes the right to display your Competition Entry on the Website, social media channels, promotional materials, exhibitions, presentations, and other official Design Battle publications.

You represent and warrant that:

you own or have all necessary rights to submit your Competition Entry;
your submission does not infringe the intellectual property or other rights of any third party;
any third-party materials included in your submission have been used with appropriate authorization.

Unless expressly permitted by the applicable competition rules, participants may not submit plagiarized, fraudulent, misleading, or unlawful content.

Where a Competition permits the use of artificial intelligence ("AI") tools, participants must comply with the applicable competition rules. Participants remain fully responsible for the originality, legality, and accuracy of all submitted work, regardless of whether AI tools were used.

6. Payments and Refunds

Some Competitions or Services may require payment of a participation fee or other charges.

All applicable prices, payment methods, and payment deadlines will be published on the Website or within the relevant Competition.

Unless otherwise stated, all fees are non-refundable once registration has been completed or access to the relevant Service has been provided.

If a Competition is cancelled by Design Battle before it begins, participants may receive a refund or another remedy determined by Design Battle.

Nothing in these Terms limits any mandatory consumer rights that may apply under applicable law.

7. Acceptable Use

When using the Website and our Services, you agree to act lawfully, responsibly, and respectfully toward other users and the Design Battle community.

You agree not to:

violate any applicable laws or regulations;
infringe the intellectual property or other rights of third parties;
submit false, misleading, offensive, defamatory, discriminatory, or unlawful content;
upload malware, viruses, or other harmful code;
interfere with the operation or security of the Website;
attempt to gain unauthorized access to any part of the Website or another user's account;
impersonate another person or organization;
engage in fraudulent, abusive, or deceptive conduct;
use automated tools or bots to manipulate Competitions, voting, rankings, or other Website features without our prior written permission.

Design Battle reserves the right to investigate suspected violations of these Terms and to take any action reasonably necessary to protect the integrity of the Website and its users.

8. Disclaimers and Limitation of Liability

The Website and Services are provided on an "as is" and "as available" basis.

While we make reasonable efforts to maintain the availability, accuracy, and security of the Website, we do not guarantee that the Services will always be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by applicable law, Design Battle shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Website or Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

Design Battle does not guarantee that participation in any Competition will result in awards, prizes, employment opportunities, commercial success, or professional recognition.

9. Suspension and Termination

Design Battle may suspend or terminate your access to the Website or any Service if we reasonably believe that you have:

violated these Terms;
violated applicable competition rules;
engaged in fraudulent, abusive, or unlawful conduct;
infringed the rights of other users or third parties;
compromised the security or integrity of the Website.

Where reasonably possible, we will notify you before taking such action. However, immediate suspension or termination may occur where necessary to protect the Website, other users, or comply with legal obligations.

You may stop using the Website or close your account at any time.

Termination of your account does not affect any rights or obligations that arose before termination, including any licenses granted under these Terms.

10. General Provisions

These Terms constitute the entire agreement between you and Design Battle regarding your use of the Website and Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

These Terms shall be governed by the laws applicable to the Organizer's principal place of business, unless mandatory provisions of the law applicable to you require otherwise.

Any disputes arising out of or relating to these Terms should first be resolved through good-faith negotiations. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts having jurisdiction under applicable law.
